A court in Alicante has made public a sentence condemning
Ryanair to return a charge incurred by four passengers for taking their hand
luggage into the cabin.
Charging to take hand luggage in to the cabin contravenes the Air Navigation
Law.
This sentence adds to a previous one in Madrid in October 2019 against which there
is no appeal and opens the door for thousands of passengers to make claims
against Ryanair for their hand baggage policy.
The sentence which condemns Ryanair to refund the charge paid in order to take
a suitcase, rather than a bag, forms part of Article 97 of the Air Navigation
Act which establishes that the airline is obliged to transport together with
the passenger and included in the price of the ticket, luggage within the
weight limits, without regard to the number of packages or their volume
including items bought at the airport.
