Former workers at the Conservas Ferandanez canning plant (formerly known as the Diosa) are considering an action for damages folowing the superior court decision that redundancy notices issued to 311 employees were ilegal.
The ruling, by the Superior Tribunal of Justice of Murcia, finds in favor of the workers and anuls the redundancy notices, overuling the decision of the General Director of Work on June 11, 2009 to approve them.
In November 2008 Conservas Fernandez issued redundancy notices (ERE), due to lack of contracts, to the entire workforce of 311 workers: 34 full time and 27 part time staff.
This sentence also rules in favour of severance payments claims made by the workers of 45 working days per year and 42 months as opposed to the 20 days and 12 moths applied in the redundancy notices.
The workers will now hold a meeting in the Municipal Auditorium to hear the judgement and discuss possible claims against their former employers for damages caused by delay due to the lengthy legal proceedings.
