An unnamed company based in Calasparra must pay a massive 233.700 euros in compensation for selling jam that was “unservable.”
The decision, by the Provincial Audience in Murcia, reverses a previous decision by courts in Caravaca which threw out the complaint and absolved the company.
In the new decision the court finds that “the jam produced by the company was unsuitable for sale, it was insufficiently “gelled” and had crystals of cream of tartar in the bottom of the jars.
“This is considered to be a breach of contract because the product did not meet the requirements for the production of ecological jam.”
The sentence, granting the appeal, condemns the company to pay its customer company 233.700 euros for 60.000 kilos of grapes, transport, other costs and losses.
