The Government has
introduced a ban on constructive dismissals as a response to Coronavirus.
The ban on this type of dismissal will take effect from today but is not
effective retrospectively.
The Ministry of Work and Social Economy, Yolanda Diaz, has announced that the
Executive Committee´s approval for a
block of social measures to protect workers during the crisis.
«No one can use this health crisis for their own gain, no one can use
Covid 19 as an excuse for dismissal,”she said.
The government has approved a legal clause that bans dismissals for
«fuerza mayor» that is as an
extreme measure or for economic, technical, organizational or reasons related
to productivity, that originate from or use the Coronavirus crisis as a reason
to justify the dismissal.
This measure has been introduced in addition to the requirements and conditions of the Temporary
Employment Regulation Files (ERTE) (often used as temporary suspension for
seasonal workers etc) in an effort to protect employment.
